NEW DELHI: Hundreds of Central Secretariat Service (CSS) officers who have been agitating against denial of promotions due to them could get an early redressal with Union minister for personnel Jitendra Singh having initiated the process of handing them their long-overdue elevated positions.
Sources said while attorney general KK Venugopal had until now taken the view that the government must continue to hold back the promotions, despite the nearly 12,000 vacancies, until the batch of related cases in the Supreme Court reaches a finality, the government was of the opinion that the injustice must end as there was no stay or any direction from the SC to the contrary.
There were nearly three to four rounds of discussions between the government and its legal advisors in this regard and finally it was decided that the file relating to CSS promotions should be moved so that promotion orders can finally be issued.
While doing so, the government, as advised by the AG, ensured that it also reiterated the Supreme Court direction — issued in the cases of Jarnail Singh & Ors and Lachhmi Narain Gupta & Ors — regarding the procedure for granting reservation to Scheduled Castes and Scheduled Tribes in promotions.
In an office memorandum (OM) issued by the department of personnel and training (DoPT), the three conditions set by the SC for the government for implementing the policy of reservation in promotions were reiterated. These include collection of quantifiable data regarding inadequacy of representation of SCs and STs; application of this data to each cadre separately; and if a roster exists, making cadre the unit for operation of the roster and collecting and applying quantifiable data for filling up vacancies in the roster.
The secretaries of all Union ministries and departments were directed that since the Jarnail Singh batch of cases is pending before the SC, any promotion order issued shall be subject to further orders that may be passed by the apex court. Around 1,800 vacant posts exist at the levels of section officer, undersecretary, deputy secretary, director and joint secretary against their sanctioned strength of 6,210. More than 2,700 officials are working on ad hoc promotions.
